Kentucky court resolves coverage dispute, Westport Insurance wins

In 2016, Virgil filed a lawsuit in federal court under 42 USC § 1983 against the City of Newport and former and current employees of the Newport Police Department. He alleged violation of the constitutional right to a fair trial, malicious prosecution, fabrication of false evidence, negligence in supervisory duties and oversight, failure to intervene, conspiracy to deprive constitutional rights, and intentional infliction of emotional distress. He seeks compensation for pain and suffering during incarceration, adverse conditions faced after incarceration and damages “including, but not limited to, physical injury, mental anguish and loss of normal life” caused by Newport’s misconduct.
