Delaware court supports free mutual aid and strengthens insurance company settlement rights

The case was tried by a jury in December 2024, focusing on the liability of the infringer and the value of carpenter injury. The jury found the carpenter’s injury worth $5,000. Since Carpenter had already received $25,000 from Tortfeasor’s insurance company, the court ruled on the UIM claim in favor of Liberty Mutual, finding no further payment was required.
