Michigan court blocks Citizens Insurance’s request to terminate PIP arbitration

Bazzy originally sued Citizens in 2008 in Wayne Circuit Court. The parties subsequently agreed to submit the dispute to binding arbitration and on February 19, 2009, a stipulated order was entered into dismissing the case without prejudice. The written arbitration agreement, signed on or about March 24, 2009, sets out the arbitrator’s duties: to determine the nature and extent of Bazzy’s injuries, whether they were caused by the accident, whether he is entitled to no-fault benefits from the citizens, and the amount of damages. The Agreement provides that the written decision of the two arbitrators will be binding and will represent the complete and final resolution of all past and present no-fault PIP interests as of the date of arbitration.
