California court blocks FAIR Plan property insurance liability authorization

The dispute stems from Order 2021-2, which directs FAIR Plan to file a homeowners policy that covers, at a minimum, accidental discharge or spillage of water or steam; premises liability; incidental workers’ compensation; theft; falling objects; weight of ice, snow or sleet; freezing; loss of use, including additional living expenses and fair rental value. The FAIR program requested a warrant, arguing that liability and similar third-party protections were beyond the scope of the statute.
