Federal insurance company faces lawsuit over alleged refusal to pay assessment costs

When the parties cannot agree on the amount of loss or damage, the assessment provisions set forth in the policy endorsement apply. Upon written request, each party selects a competent and impartial appraiser and notifies the other party. The appraiser then selects a competent and impartial referee. If the appraisers cannot agree, they take their differences to a referee, and any two of the three can agree to determine the amount of the loss. The appraiser lists each loss separately and then totals it. Both parties pay the appraisal fee, and the appraisal fee and the referee fee are shared equally.
