Tanger Properties takes ACE and Liberty Mutual to court over COVID-19 claims

After Tanger submitted its claim, both ACE and Liberty Mutual denied coverage. The insurance company claimed that Tanger did not substantiate any direct physical loss or property damage and that the claimed losses were not covered by the policy. In its response, Danger noted that the wording in its policy ensures “protection against all risks of direct physical loss or damage to the property described herein.” These policies did not contain a choice of law provision specifying which state’s law would apply to coverage disputes, but did contain a provision providing that the insurer would submit to the jurisdiction of any court of competent jurisdiction within the United States at the request of the insured.
