Tennessee court rejects auto transporter’s compensation claim after late injury report

Wayne Freeman, a former motor carrier with United Road Services, Inc., sought medical benefits for a right rotator cuff injury caused by overuse of his right arm following an injury to his left shoulder. Freeman testified that his right arm “hurt like crazy” after unloading a truck in Kingsport, Tenn., on April 6, 2024, his last day on the job before surgery on his left shoulder. However, he did not notify United Road Services or ACE American Insurance Co. of the injury to his right arm until May 1 and May 2, 2024, 25 days after the incident.
