The second case, filed in Colorado state court, involves The Grand, a mixed-use development in downtown Denver. The owners of The Grand are suing the project’s general contractor and others, alleging construction defects, including CPVC leaks. Spears was later named as a third-party defendant, facing charges of product liability and negligence. Spears filed a claim against Liberty Mutual in December 2022, but the insurance company allegedly again failed to confirm coverage, defend the company, reimburse defense costs or contribute to a settlement in November 2023, according to the complaint.
