If we can withstand the nuclear judgment: Aspen’s Wagner, E&S casualties growth is sustainable

There may be a line of relief. Wagner noted that the recent tort reform legislation in Florida and Georgia proves that policy makers are beginning to recognize the pressures from insurers, businesses and consumers. Florida’s HB 837 was passed in 2023, shortening the statute of limitations for negligence claims and changing the comparative fault rules, while Georgia’s high-level restrictions on “phantom damage” for medical expenses.
